1. OVERVIEW

This website is operated by Trim Store. Throughout the site, the terms “we”, “us”, and “our” refer to Trim Store. Trim Store offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

2. GENERAL CONDITIONS

We reserve the right to refuse service to any person for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

3. PRODUCTS AND SERVICES

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. All products are brand new and unopened.

4. PRICING AND PAYMENT

  • Currency: All prices are displayed in Australian Dollars (AUD).

  • Changes: Prices for our products are subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

  • Accepted Methods: We accept payment via Stripe, PayPal, Google Pay, and Apple Pay.

4.1 PAYMENT SECURITY

To ensure the safety of your data, we utilise industry-standard security measures:

  • PCI DSS Compliance: Our store is hosted on Wix, which is a Level 1 PCI DSS (Payment Card Industry Data Security Standard) compliant provider.

  • Third-Party Processing: Trim Store does not collect, store, or have access to your full credit card number or financial details. All transactions are processed securely through our third-party payment gateways (Stripe and PayPal). These providers securely manage your financial data in accordance with their own strict privacy policies and Australian financial regulations.

  • Encryption: Your checkout experience is protected by Secure Socket Layer (SSL) encryption technology to keep your transaction data safe.

5. PRE-ORDERS AND BACKORDERS

From time to time, Trim Store may offer products for "Pre-order" or "Backorder" (items currently out of stock but scheduled for production/restock). By purchasing these items, you acknowledge and agree to the following:

  • Immediate Payment: Payment is collected at the time of checkout to secure your reservation of the stock.

  • Estimated Timelines: Shipping dates listed on the product page are estimates only and are subject to change due to production or logistics delays. We will endeavor to notify you of any significant changes to the timeline.

  • Combined Shipping: If your order contains both in-stock items and pre-order/backorder items, your entire order will be held until all items are in stock and ready to ship together. If you require the in-stock items immediately, please place two separate orders.

  • Cancellation: You may cancel a pre-order or backorder for a full refund at any time before a shipping label has been created. Once the item is in the fulfillment process, our standard Return Policy applies.

6. ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

7. SHIPPING, DELIVERY, AND SECURITY

  • Carrier: We utilise Australia Post for deliveries.

  • Dispatch Speed: We prioritise efficient processing. In-stock items are typically dispatched within Same day - two business days of order confirmation.

  • Delivery Timelines: Delivery times provided at checkout are estimates only and are based on the service levels of our carriers (e.g., Australia Post Express vs. Standard). While we aim for speed, we are not liable for delays caused by the carrier or events outside our control (e.g., severe weather, strikes).

  • Security & Tracking: All orders are shipped with a tracking number, which will be emailed to you upon dispatch.

  • Insurance: Our shipping costs include transit insurance up to the value of $100. If your package is lost or damaged in transit before confirmed delivery, we will work with the carrier to resolve the issue.

  • Risk of Loss: Ownership and risk of the products pass to you upon our delivery to the carrier. However, we will assist you in lodging claims with the carrier for lost items where possible.

  • International: If you order from outside Australia, you are responsible for any customs duties, taxes, or import fees levied by your country.

8. RETURNS AND REFUNDS (AUSTRALIAN CONSUMER LAW)

  • Consumer Guarantees: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

  • Change of Mind: We offer a 30-day return window for Change of Mind purchases, subject to strict conditions (e.g., items must be unopened and factory-sealed). For full details and requirements, please see our Refund Policy.

9. INTELLECTUAL PROPERTY & CHARACTER RIGHTS

  • Site Content: All content included on this site, such as text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Trim Store or its content suppliers and is protected by Australian and international copyright laws.

  • "Nena Sader" Character Rights: The character known as "Nena Sader", including but not limited to her name, backstory, visual likeness, facial geometry, specific costume designs (including the "Sader Suit" armor configurations), character universe "Saderverse" and distinct attributes, is the exclusive intellectual property of Trim.

  • Prohibited Use: You may not use, reproduce, or manipulate the likeness of Nena Sader or any associated assets for any commercial purpose, including but not limited to AI model training, deepfakes, promotional materials, or merchandise, without express written consent from Trim.

  • Enforcement: Any unauthorized use of the Nena Sader character or Trim branding will be pursued to the fullest extent of the law.

10. THIRD-PARTY LINKS

Certain content, products, and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

11. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

12. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
